An Open Letter to IT& TELECOM Minister Kapil Sibbal

Subject: Concerns regarding Section 66A

Dear Sir,

We are writing to you on behalf of all law-abiding citizens of the country and I wish to put on record our enormous concerns regarding Section 66A of the Information Technology (Amendment) Act 2008.

We are appealing to your good sense because you have recently displayed responsiveness by issuing guidelines aimed at limiting the use of Section 66A in the wake of politically driven arrests of two girls from Mumbai.

Sir, the constitutionality of Section 66A is under question in the highest court of India. To the best of my knowledge, the Section does not have any precedents in the Indian Penal Code. In a non-Internet context, this means that the Act of sending repeated communications (letters, etc.) to a person in itself may not be a cognisable offence that would prescribe a term of upto 3 years. However, if the content of the communication, in a given context, is such as may be punishable under the law of the land, or if the manner of sending such communications is such as is deemed unacceptable under law, then the sender of such communication may be tried under proper provisions of the law and awarded proportionate punishment. In the language of the common men and women who I represent, this would simply mean that sending repeated letters for, say, recovery of money would not attract the same punishment as sending repeated letters containing rape threats. However, sir, Section 66A does just that- prescribes similar treatment for various different offences!

We do understand the concerns of the government regarding rising cyber crime but, sir, we’re afraid that the present IT Act fails to do that. As recently disclosed in the Rajya Sabha, the number of people arrested under the IT Act so far is 1600 while the number of convictions is a shocking seven! Out of these seven convictions, only three are significant cases.

We appreciate the fact that you are concerned for women’s safety on the Internet. However, many women, including feminists, have said on record that the section doesn’t do much to protect them. I’m of the opinion that, if the Section is really meant to protect women, then there should be another sections in the IT to protect their rights.


We want you to take note of the language in the Section 66 A- “directed communication”, “unsolicited”, “consent”, “persistently”- these words are key to an effective legislation and they’re missing in Section 66A which instead uses terms like “offense”, “insult”, “. Any real woman who has faced online abuse would agree with this, more or less. This should be a good enough reason to scrap Section 66A unless the purpose of such legislation is made clear.

Section 66A invents new crimes such as causing annoyance, insult and inconvenience. We are well within our Constitutional right to offend, annoy, inconvenience or even insult institutions, practices, individuals, etc. as long as it is within the limits of decency and does not border on hate speech. Even potentially violent speech must pass various tests like “public nature, impact, incitement to violence, context, etc.” to qualify as hate speech but Section 66A, or the IT Act of which it is a part, does not have any such safeguards.

You had issued guidelines on 29th November, 2012 to prevent the abuse of Section 66A. Yesterday, on 13th December, 2012, a 20-year old boy was booked under Section 66A for having sent a birthday cake to a girl he loved. The birthday cake had a picture printed over it that he had taken from Facebook. Although a case could be made out for booking the boy under other relevant sections of the IPC that deal with stalking, etc. the use of Section 66A is beyond our comprehension. How does sending a birthday cake amount to “sending offensive messages through electronic medium”? Although this is not the ugliest instance of the abuse of Section 66A, it does make a laughing stock of our legal system. More often than not, the Section has been used for avenging political or personal rivalries, forcing critics into silence and as a substitute for undefined crimes such as cyber squatting (pratibhapatil.com case), uploading cartoons to a website (Aseem Trivedi case), creating an image meme out of perfectly decent public photographs of politicians (Mamata Bannerjee Ambikesh Mahapatra case), criticising a bandh  (Shaheen Dhada case) and so on.

We have submitted ourselves to the law of this land and we are strong believers in the rule of law. We do believe that no man is above the law but we would also like to stress that no provision of law should be above the Constitution of India. I, a directly affected party under Section 66A, have been on a fast for a week now along with my activist friend Alok Dixit. We haven’t heard from the government or any of its representatives yet. This shows the alarming lack of concern to citizens’ genuine demands and their health, well-being, rights and life among the lawmakers.

We have taken this step because all advocacy and activism has failed to get your government to remove the law or to, at least, amend it to civil society’s satisfaction. We urge you to take note of our concerns and take some serious steps towards resolving this deadlock as soon as possible.

The India that Rabindranath Tagore had envisioned was one where “the mind is without fear and the head is held high”. Today, the Palghar girls, Shaheen Dhada and Rinu Srinivasan can be seen covering their faces despite having committed no crime while the head of the mob that rampaged Shaheen’s family clinic gives unapologetic interviews in national news. Is this the kind of India we want our children to grow up in?

Aseem Trivedi likely to be expelled from ‘Bigg Boss’: क्या राजनैतिक दल के दबाव में आ गया कलर्स?



 रामदास अठावले ने कलर्स चैनल को धमकी दी थी कि अगर 28 अक्टूबर तक असीम को बाहर न निकाला गया तो 29 अक्टूबर को वे बिग बास के घर पर हमला बोल कर असीम को शो से बाहर निकाल देंगे. 


रियलिटी शो बिग-बास में कंटेस्टेंट असीम त्रिवेदी को बाहर किये जाने की मांग को लेकर प्रदर्शन कर रहे रामदास अठावले के आगे कलर्स चैनल का मैनेजमेंट झुकता नजर आ रहा है. रामदास अठावले के मुताबिक चैनल ने असीम त्रिवेदी को बिग-बास हाउस से बाहर किये जाने की उनकी मांग मान ली है. कलर्स के अधिकारियों ने भी अठावले और उनके बीच बातचीत होने की पुष्टि की है. मालूम हो कि रामदास अठावले ने कलर्स चैनल को धमकी दी थी कि अगर 28 अक्टूबर तक असीम को बाहर न निकाला गया तो 29 अक्टूबर को वे बिग बास के घर पर हमला बोल कर असीम को शो से बाहर निकाल देंगे. 

रामदास अठावले रिपब्लिकन पार्टी आफ इंडिया के प्रेसीडेंट हैं और कांग्रेस व एनसीपी से उनकी काफी करीबियां हैं. असीम को भ्रष्टाचार विरोधी कार्टून बनाने के लिये पहले भी परेशान किया जा चुका है. कांग्रेस के पदाधिकारी राजेन्द्र प्रताप पांडेय की शिकायत पर असीम की वेबसाइट www.cartoonsagainstcorruption.com को पिछले साल दिसम्बर में बैन कर दिया गया था. बाद   में उन्हे गैरकानूनी तरीके से महाराष्ट्र सरकार ने देश-द्रोह का आरोप लगा कर जेल भेज दिया. महाराष्ट्र हाईकोर्ट ने पुलिस द्वारा असीम पर देश-द्रोह का मुकदमा लगाए जाने और उन्हे गिरफ्तार करने के लिये सरकार को लताड़ लगाई. इस बीच कुछ आपराधिक तत्वों द्वारा असीम को धमकी भरे फोन भी किये गये थे और कहा गया था कि असीम को महाराष्ट्र आने पर गंभीर परिणाम भुगतने होंगे. 

असीम को भ्रष्टाचार के खिलाफ लड़ी जा रही उनकी लड़ाई के लिये लगातार परेशान किया जा रहा है जबकि उनका व्यवहार बिग-बास के घर में भी बेहद सराहनीय रहा है और वहां रह रहे सभी कंटेस्टेंट असीम का सम्मान करते हैं. भारतीय क्रिकेट टीम के पूर्व कप्तान नवजोत सिंह सिद्धू ने तो असीम को 24 कैरेट खरा सोना तक कह दिया. पिछले 18 दिनों में असीम ने रियलिटी शो में कोई ऐसा कार्य नहीं किया है जिससे राष्ट्र या किसी विशेष बिरादरी का अपमान होता हो. असीम ने बिग-बास के मंच को अपने आन्दोलन को जनता तक पहुचाने के लिये ही इस्तेमाल किया है. बिग-बास के घर में जाने से पहले ही असीम ने यह स्पष्ट कर दिया था कि वे मनोरंजन करने के इरादे से नहीं बल्कि लोगों के बीच भष्टाचार के खिलाफ एक अलख जगाने के लिये बिग-बास हाउस जा रहे हैं.

इसके उलट रामदास अठावले न सिर्फ सार्वजनिक तौर पर असीम को धमकी दे चुके हैं बल्कि खुद बाबा-साहब अंबेडकर के बनाए संविधान का अपमान भी कर चुके हैं. अठावले ने गैर कानूनी तरीके से और कागजों में हेरा फेरी कर मुंबई में करोड़ों की कीमत की जमीन हथिया ली थी. 2009 में एक और मामले में प्रशासन को कई नोटिसों के बाद भी अपना सरकारी बंगला खाली न कर रहे अठावले पर कार्यवाही करनी पड़ी थी. ऐसे में खुद संविधान की धज्जियां उड़ा चुके अठावले द्वारा असीम पर संविधान के अपमान का आरोप लगाना पूरी तरह बेबुनियाद और हास्यास्पद है. 

सेव योर वॉयस इसे सरकार और सत्तारूढ़ दल कांग्रेस की असीम त्रिवेदी और उनके द्वारा भ्रष्टाचार के खिलाफ लड़ी जा रही लड़ाई के खिलाफ एक साजिश मानता है. हम महाराष्ट्र के राजनैतिक दल द्वारा कार्टूनिस्ट की अभिव्यक्ति पर किये गए इस हमले की भरषक निन्दा करते है. हम गृह मंत्रालय से इस दल के खिलाफ कार्यवाही करने की भी अपील करते हैं.

Has the Color management bowed down to the pressure of political party demanding the Eviction of Aseem Trivedi?

Demanding the eviction of one of its inmates, cartoonist Aseem Trivedi, and the Republican Party of India (RPI) leader has managed to bow down the Colors management in front of him by threatening the shutdown of Channel’s broadcasting from Lonavala in Maharashtra. It seems that channel has agreed to expel Aseem Trivedi as its officials assured RPI president Athavale the expansion of Trivedi from Big Boss house. According to media reports, about 5,000 marchers, led by RPI chief Ramdas Athavale, were gathered outside the Big Boss house when Athvale threatened TV channel to evict Aseem till Oct 28 or face action on 29.

Ramdas Athwale shares good relations with NCP and Congress president Sonia Gandhi (what he mentions in a video interview) and his protest against Trivedi seems a quid pro quo between him and congress led state government. Aseem is regularly facing trouble for his anticorruption cartoons campaign which he started in September last year. He was sent to jail by filing false charges against him for which Hight Court of Maharashtra condemned the state government and charges were withdrawn after the strong campaign led by free speech supporters.  Aseem has also got many threat calls by the extremists which again was an condemnable step to suppress his voice by few antisocial groups.

Aseem is facing all this because he has raised his voice against corrupt system and was considered antigovernment by the ruling parties. Aseem’s behavior in Big Boss house is appreciable and every member of the house loves and respects Aseem for his lifestyle. Aseem’s co-contestant and renowned ex cricketer Navjot Singh Siddhu compared him with the pure 24 carat gold when asked by the Big-Boss.  Aseem has not done anything anti-national or anti-social for which his expansion can be assumed. He is rather using Big Boss’s show as a platform where he can spread his message to the citizens of India. Before joining Big Boss he clearly said he will not do entertainment inside the Big Boss house. "I believe viewers want to watch things other than entertainment on TV. Aamir Khan's show 'Satyamev Jayate' was a serious show, it wasn't to entertain. But people watched it. A huge chunk of people want to watch serious issues too," Trivedi told reporters before joining the Big Boss team.

At th other hand, the house owned by Athavale is built on the land which was obtained by his father-in-law Yadavrao Wadkar in 1993 for being homeless and claiming freedom fighter turned out to be retired deputy commissioner of Central Excise. When land was allotted Mr Athawale was social welfare minister in the then Maharashtra Government. In another case in 2009, authorities had to take strong actions against Athavale for not evacuating his government bungalow after repeated notices by the authorities.

Save Your Voice condemns this illegal threatening by the corrupt RPI leader in a democratic country like India and demands a strong action by the Maharashtra Government.

ये वही रामदास आठवले है जो अपने आपको Soniya Gandhi का जानकार बताते है और Aseem Trivedi को घर से बाहर निकलवाने के लिए खुद को संविधान का अनुयायी बताते है. 

रिपब्लिकन पार्टी आफ इंडिया की धमकी के दबाव में आकर कलर्स चैनल ने कहा है कि वे असीम को इस हफ्ते बिग-बास हाउस से निकाल देंगे. आखिर किस बात का विरोध कर रहे हैं

कार्टूनिस्ट असीम की फ्री स्पीच पर न हो हमला- सेव योर वॉयस


इससे पहले भी कुछ आपराधिक तत्वों द्वारा कार्टूनिस्ट असीम को धमकी भरे फोन भी किये गये थे और कहा गया था कि असीम को महाराष्ट्र आने पर गंभीर परिणाम भुगतने होंगे.


देशद्रोह के गलत आरोपों पर जेल जा चुके कार्टूनिस्ट असीम त्रिवेदी को एक राजनैतिक दल को ओर से बिग-बास के घर से बाहर निकालने की धमकी दी जा रही है. असीम एक समाजसेवी कार्टूनिस्ट हैं जो कि भ्रष्टाचार के खिलाफ अपनी लड़ाई के लिए सारी दुनिया में जाने जाते हैं. हम सेव योर वॉयस के को-फाउंडर और कार्टूनिस्ट असीम त्रिवेदी की अभिव्यक्ति की आजादी पर किये जा रहे इस हमले का विरोध करते हैं. साथ ही हमारी महाराष्ट्र सरकार से भी अपील करते हैं कि वह लोनावला स्थित बिग-बास के घर पर असीम की सुरक्षा सुनिश्चित करे.

कार्टूनिस्ट असीम त्रिवेदी को इससे पहले भी भ्रष्टाचार के खिलाफ लड़ाई लड़ने के लिये परेशान किया जा चुका है. महाराष्ट्र हाईकोर्ट ने पुलिस द्वारा असीम पर देश-द्रोह का मुकदमा लगाए जाने और उन्हे गिरफ्तार करने के लिये सरकार को लताड़ भी लगाई थी. इससे पहले कुछ आपराधिक तत्वों द्वारा असीम को धमकी भरे फोन भी किये गये थे और कहा गया था कि असीम को महाराष्ट्र आने पर गंभीर परिणाम भुगतने होंगे. दुनिया के सबसे बड़े डेमोक्रेटिक देश में इस तरह की धमकियों को न सिर्फ देश और उसके संवैधानिक मूल्यों का अपमान माना जाना चाहिये बल्कि किसी कलाकार की कला को दबाने की अनुचित और शर्मनाक सेंसरशिप के तौर पर भी देखा जाना चाहिये. सेंसरशिप के खिलाफ लड़ाई लड़ रही सेव योर वाइस टीम महाराष्ट्र के राजनैतिक दल द्वारा कार्टूनिस्ट की अभिव्यक्ति पर किये गए इस हमले की भरसक निन्दा करती है. साथ ही हम गृह मंत्रालय से इस दल के खिलाफ कार्यवाही करने की भी अपील करते हैं.

फिलहाल हम हार गये हैं, लेकिन फिर भी हम लड़ेंगे साथी

देश में इंटरनेट सेंसरशिप के खिलाफ लड़ी जा रही लड़ाई फिलहाल हम हार गये हैं। हमने हंगामा खड़ा किया, लोगों के बीच गये, तथाकथित जनप्रतिनिधियों को दास्ताने जंग सुनायी और संसद में भी बहस छेड़ी। नतीजा? ढाक के वही तीन पात। हम राज्यसभा में आईटी एक्ट के एनलमेंट का प्रस्ताव लाये जो कि माननीयों की अनिच्छा और कमजोर हो चुके विपक्ष के दोहरे चरित्र के चलते गिर गया और इसी के साथ भारत दुनिया के तमाम उन तानाशाह देशों की फेहरिस्त में शुमार हो गया, जो कि इंटरनेट को सेंसर करने की भरपूर वकालत करने में जुटे थे। अब इस कोशिश में अंतर्राष्ट्रीय नेटएक्टिविस्ट ‘एनॉनिमस’ भी उतरे हैं और आने वाले 9 जून को देशव्यापी प्रोटेस्ट कर रहे हैं। उनका यह विरोध वीडियो शेयरिंग वेबसाइट ‘विमियो’ और ‘डेलीमोशन’ की ब्‍लॉकिंग के बाद शुरू हुआ है। एनॉनिमस का मानना है भारत में जिस तरह रिलाइंस समूह अपनी फिल्मों के बाजार को बचाने के लिए वीडियो और दूसरी साइट्स को ब्लैंकेट बैन कर रही है, उससे दुनिया भर के इंटरनेट उपभोक्ताओं में रोष बढ़ा है। एनॉनिमस ने फिलहाल देश के 11 शहरों में अपना यह विरोध दर्ज कराने का ऐलान किया है। हमने भी पिछले कई महीनों में सेंसरशिप के खिलाफ तमाम अभियान छेड़े और कोशिश की हम इस मुद्दे पर देश में एक डिबेट शुरू कर पाये। हमने नेशनल टूर किया, सिटीजन मीट की, विरोध प्रदर्शन किये, क्रिएटिव प्रोटेस्ट किये और भूख हड़ताल भी की। अफसोसजनक नतीजों के साथ बताना चाहता हूं कि डिबेट तो शुरू हुई, पर यह डिबेट सिर्फ ट्विटर और फेसबुक और कुछ अंतर्राष्ट्रीय अंग्रेजी अखबारों में ही बड़ी मुश्किल से अपनी जगह बना सकी। लोग सड़कों पर नहीं उतरे और इस बीच हमने खुशी खुशी इंटरनेट पर लिखने की अपनी आजादी गंवा दी।
देश दुनिया में इस वक्त इंटरनेट निर्णायक मोड़ पर है। अपने जमीनी स्वरूप और लोगों के बीच इसकी पैठ की वजह से यह आज का सबसे शक्तिशाली आर्थिक इंजन और सकारात्मक सामाजिक ताकत बन गया है। मगर इसकी सफलता ही दुनियाभर की ताकतों के लिए चिंता का विषय भी बन गयी है। अपनी तानाशाही से सारी दुनिया को मुंह चिढ़ाते बहरीन, मिस्र, ट्यूनीशिया, सीरिया और लीबिया जैसे देश हों या अभिव्यक्ति की आजादी का ढिंढ़ोरा पीटता अमेरिका और वहां हुआ अकूपाई मूवमेंट हो, इंटरनेट ने न सिर्फ हंगामा खड़ा कर दिया बल्कि सूरत भी बदली। यही वजह है कि सारी दुनिया की दमनकारी सरकारें (जिसमें हमारा देश भी शामिल है) इस माध्यम से मिली अभिव्यक्ति की स्वतंत्रता और मौलिक अधिकारों को नियंत्रित करने के लिए या तो कई तरह के कानून बना रही हैं या इस प्रक्रिया में हैं। समूचे विश्व में इंटरनेट को सेंसर करने वाली सरकारों की संख्या 2002 में 4 के मुकाबले आज 40 पहुंच गयी है। भयावह यह है कि यह संख्या तेजी से बढ़ रही है और इंटरनेट के उस स्वरूप को पूरी तरह बदलने में लगी है, जिसे हम और आप आज जानते हैं।
इनमें से कुछ कदम तो उन कारणों से उठाये जा रहे हैं, जो कि आमतौर पर इंटरनेट को बदनाम और नियंत्रित करने के लिए जिम्मेदार हैं। कहा गया कि इंटरनेट धार्मिक विद्वेष फैला रहे हैं, इंडिविजुअल को टार्गेट कर रहे हैं और नेशनल सेक्योरिटी के लिए खतरा बन रहे हैं। पर हमें मानना होगा कि लगभग हर बुनियादी ढांचे की तरह इंटरनेट का भी दुरपयोग किया जा सकता है और इसके उपभोक्ताओं को नुकसान भी पहुंचाया जा सकता है। हमें यह भी ध्यान जरूर रखना चाहिए कि कहीं ऐसा न हो कि हम बीमारी का इलाज करते-करते बीमार को ही मार डालें। ओपेन और सुलभ इंटरनेट के फायदे गिना पाना तो शायद असंभव ही है और इसके बिना इंटरनेट की कल्पना भी नहीं की जा सकती है।
आश्चर्यजनक रूप से सारी दुनिया के इंटरनेट को नियंत्रित करने के लिए यूनाइटेड नेशंस का एक संगठन, इंटरनेशनल टेलीकम्युनिकेशन यूनियन (आईटीयू), जो कि अपने साथ 193 देशों के होने का दावा करता है, अपना मोर्चा खोल रहा है। यह टेलीकम्युनिकेशंस को नियंत्रित करने वाले अंतर्राष्ट्रीय समझौतों की समीक्षा कर रहा है और दिसंबर में दुबई में हो रही इंटरनेट सम्मिट में इंटरनेट पर यूनियन के अधिकारों को बढ़ाये जाने का प्रस्ताव रख सकता है। यह कदम काफी खतरनाक है, क्यूंकि इससे इंटरनेट का स्वरूप शायद वैसा नहीं रह जाएगा, जैसा कि आज है। वर्तमान में आईटीयू का नियंत्रण रेडियो फ्रीक्वेंसीज पर है और वह इन फ्रीक्वेंसीज का एलोकेशन करता है, न कि इंटरनेट का। कुछ सदस्य आईटीयू के दायरे में इंटरनेट को भी लाना चाह रहे हैं। 193 सदस्‍यों में हर एक के पास वोट करने का अधिकार है, बिना इसे जाने कि मौलिक अधिकारों पर इनका रुख क्या है, और एक सामान्य बहुमत भी आईटीयू के दायरे को बढ़ा कर इंटरनेट तक ला सकता है।
दुनियाभर में इंटरनेट को डेवलप करने वाली कंपनियों और आईटी एक्सपर्ट्स ने इसे ओपेन और एक्सेसबल बनाते हुए खुद भी नहीं सोचा होगा कि यह इंसान और इंसानी दुनिया के इतने आयामों को अपने आगोश में ले लेगा। फिलहाल जब इंटरनेट की कमान किसी एक देश या एक शक्ति के हाथ में नहीं है, दुनिया भर के अलग अलग देशों में यह समाज, शिक्षा, निजी क्षेत्रों, सेल्फ स्टैंडर्ड्स के डेवलपमेंट के साथ साथ आपसी सहयोग के तमाम पत्थर गाड़ता जा रहा है। खुले और स्वैक्षित नेट के ही ये सारे वरदान हैं। इसके विपरीत आईटीयू के होते सिविल सोसाइटी की भागीदारी में तमाम बाधाएं आएंगी।
दुनिया भर में इंटरनेट पर राय रखने वाली दो तरह की सरकारें हैं, एक जो इंटरनेट को नियंत्रित करने के लिए लचीला रुख अपनाए हुए हैं और दूसरी जो कि संयुक्त राष्ट्र की देखरेख में इंटरनेट को नियंत्रित करने के लिए एक अंतर्राष्ट्रीय संस्था की मांग कर रही हैं। दूसरे ग्रुप का नेत्रत्व करने वाले वे देश हैं, जो अपने राज्यों में इंटरनेट को तेजी से सेंसर कर रहे हैं। पिछले जून में रूस के प्रधानमंत्री पुतिन ने रूस और उसके सहयोगी देशों की आईटीयू के माध्यम से ‘इंटरनेट पर अंतर्राष्ट्रीय नियंत्रण’ की वकालत की थी। सितंबर 2011 में रूस, चीन, तजाकिस्तान और उजबेकिस्तान ने संयुक्त राष्ट्र महासभा में ‘सूचना सुरक्षा पर एक अंतर्राष्ट्रीय आचार संहिता’ बनाने का प्रस्ताव भी रखा। इसमें यह भी मांग की गयी कि देशों के लिए साइबर स्पेस से जुड़े हुए तमाम पहलुओं पर अंतर्राष्ट्रीय मानक और नियम बनाए जाएं।
आईटीयू के अंदर से भी कुछ प्रस्ताव आये हैं। कई सत्तावादी देश इंटरनेट की एनानिमिटी यानि पहचान छुपाने की खूबी को भी खत्म करने का प्रस्ताव रख रहे हैं। इससे उन आवाजों को नियंत्रित करना आसान हो जाएगा, जो उन दमनकारी ताकतों के खिलाफ आवाज उठा रही हैं। कुछ और प्रस्ताव भी आये हैं, जिनमें कहा गया है कि डोमेन के नाम और इंटरनेट ऐड्रेसेस का अधिकार संयुक्त राष्ट्र को दे दिया जाए। अगर इन सब प्रस्तावों को मान लिया जाता है तो इंटरनेट का वास्तविक स्वरूप ही बदल जाएगा। कई देशों ने इन प्रस्तावों के साथ अपनी सहमति जतायी है। कुछ इस कारण से इसके साथ हैं कि इंटरनेट का नियंत्रण संयुक्त राष्ट्र के हाथों में दिया जा रहा है। कुछ इसे अमेरिका और यूरोपीय देशों के हाथों से खिसकती ताकत के रूप में देखते हैं। कुछ का मानना है वर्तमान परिस्थितियों में इंटरनेट बड़ी वैश्विक कंपनियों के हाथों का खिलौना बना हुआ है, जबकि कुछ देश मानते हैं कि आईटीयू के पास इंटरनेट अधिकारों के आ जाने से विकासशील देशों का भला होगा और इंटरनेट तेजी से इन देशों में जा पहुंचेगा।
अब सोचने वाली बात यह है कि जिस संयुक्त राष्ट्र में चीन और रूस अपना वीटो पावर रखते हैं और जिसके सदस्य देश खुद फ्री स्पीच के सबसे बड़े दुश्मन हैं, इंटरनेट के वर्तमान स्वरूप से कितना संतुष्ट होंगे। संयुक्त राष्ट्र खुद में ही कितना स्वतंत्र और शक्तिशाली है कि सीरिया जैसे छोटे से देश को रूस और चीन के वीटो के चलते नियंत्रित नहीं कर सकता, भला इंटरनेट को क्या और कैसे नियंत्रित करेगा। तो क्या अब हम इंतजार करेंगे उस दिन का जब यूएन में बैठा चीन, डाट तिब्बत (.tibet) डोमेन के लिए वीटो कर रहा होगा? क्या हम चाहेंगे कि अब तक स्वतंत्र और स्वायत्त रहा इंटरनेट संयुक्त राष्ट्र की राजनीति और ब्यूरोक्रेसी के पिंजरे में कैद होकर अपनी रफ्तार को गंवा दे? दिसंबर में दुबई में लिये गये निर्णयों में इंटरनेट को सरकारी शिकंजे में कस देने की पर्याप्त क्षमता है। इसे इसके वर्तमान स्वरूप तक पहुंचाने के लिए हमें अब बुनियादी बदलावों की जरूरत है। आप इस तरह से हाथ पर हाथ धरे बैठे नहीं रह सकते हैं। समय कम है और खतरे ज्यादा। सेंसरशिप के खिलाफ हमारे इस अभियान में आपका साथ अनिवार्य है। साथियो चेतो।

Save Your Voice कैम्पेनर असीम त्रिवेदी को 2012 का ‘करेज इन कार्टूनिंग अवार्ड’


 इंडियन कार्टूनिस्ट असीम त्रिवेदी को कार्टूनिस्ट के अधिकारों के लिये लड़ने वाली अंतर्राष्ट्रीय संस्थाकार्टूनिस्ट राइट्स नेटवर्क इंटरनेशनल की ओर से 2012 का करेज इन कार्टूनिंग अवार्ड दिया जाएगा. वे यह अवार्ड सीरिया के प्रसिद्ध कार्टूनिस्ट अली फरजत के साथ साझा करेंगे. अली फरजत दुनिया के जाने माने कार्टूनिस्ट हैं और टाइम मैगजीन की 100 सबसे प्रभावशाली लोगों की लिस्ट में शुमार हैं. उन्हे यह अवार्ड 15 सितम्बर को जार्ज वाशिंगटन यूनिवर्सिटी, वाशिंगटन में दिया जाएगा.

      असीम एक पालिटिकल कार्टूनिस्ट हैं और उनके भ्रष्टाचार के मुद्दे पर बनाए गए कार्टूनों पर देश में काफी बवाल हुआ है. उनकी वेबसाइट को जहां मुम्बई पुलिस द्वारा बन्द करवा दिया गया वहीं महाराष्ट्र की ही बीड अदालत में उनके खिलाफ देशद्रोह का मुकदमा दर्ज कर दिया गया. अमीम को ढ़ेरों धमकियां भी मिलीं पर इस सबसे न डरते हुए उन्होने अपने साथियों के साथ मिलकर सेंसरशिप के खिलाफ देशभर में सेव योर वाइस नाम से एक मुहिम छेड़ दी. असीम और उनके साथियों की पहल रंग लाई और इंटरनेट सेंसरशिप पर देश भर में विरोध प्रदर्शन और डिबेट्स शुरू हो गईं. इन सबके बाद राज्यसभा सांसद पी राजीव आईटी एक्ट 2011 को हटाने के लिये एनलमेंट मोशन भी लेकर आए.

कार्टूनिस्ट राइट्स इंटरनेशनल दुनिया भर के कार्टूनिस्ट के हितों की रक्षा करने वाला अकेला सबसे बड़ा अंतर्राष्ट्रीय संगठन है. यह संगठन हर साल दुनिया भर के उन कार्टूनिस्ट को सहायता प्रदान करता है जो समाज की बुराइयों पर चोट करते हुए कार्टून बनाते हैं और फिर सोशल सेंसरशिप का शिकार बनते हैं. 2011 का करेज इन कार्टूनिंग अवार्ड मलेशिया के कार्टूनिस्ट जुल्फिक्ली अनवर उल हक को दिया गया था.

MohallaLive: राजघाट पर हमारी आवाज को बाकायदा कुचल दिया गया!


गर आपको जानना हो कि इस देश में डेमोक्रेसी की क्या हालत है, तो जरा मेरी एक नेक सलाह पर गौर फरमाइएगा। अपने कुछ मित्रों के साथ आप सरकार के विरोध में एक प्रोटेस्ट का प्रोग्राम रख लीजिए। इसके बाद की जाने वाली पूरी सर्कस के बाद आप शायद यह कहना बंद कर देंगे कि हम इंडिया में एक डेमोक्रेसी में रह रहे हैं और इस देश को आजादी मिल चुकी है। आपकी आवाज को कुचलने के लिए सरकार की हदों को तो आप हरगिज मत परखिएगा। यकीन मानिए आप ढेरों मुश्किलों का सामना करते करते थक जाएंगे। हमारे साथ सरकार ने किन किन दमनकारी नीतियों का सहारा लिया, इसको पढ़ लीजिए। अगर हमारी बातों पर आपको यकीन न आए, तो जरूर संपर्क कीजिए। हमें जानकर खुशी होगी कि वाकई हमारी तरह आप भी कम से कम इतना तो नहीं सोच रहे होंगे।
सेव योर वाइस की ओर से हमने एक अप्रैल को राजघाट पर कपिल सिब्बल को मूर्ख दिवस की शुभकामनाएं देने के लिए सिब्बल्स डे का आयोजन किया था। इस आयोजन के बारे में फेसबुक और दूसरे सोशल नेटवर्किंग प्लेटफार्म्स के जरिये लाखों लोगों तक फूल्स डे का मैसेज पहुंचाया गया था। कार्यक्रम में तमाम इंटरनेट यूजर्स, ब्‍लॉगर्स, पत्रकार और सामाजिक कार्यतकर्ताओं ने शिरकत करने की घोषणा की थी। इस दौरान वालस्ट्रीट जर्नल ने भी एक स्टोरी [स्‍टोरी लिंक] लिखी, जिसमें कांग्रेस प्रवक्ताओं और आईटी मिनिस्ट्री के बयान भी लिये गये। कई दूसरे अखबारों ने भी इस बाबत खबर छापी और इसी के बाद सारा खेल शुरू हुआ।
सुबह जब हम 11 बजे अपने तय समय पर राजघाट पहुंचे, हमें गेट पर ही रोक लिया गया। महात्मा गांधी की समाधि पर शांति प्रार्थना करने की भी इजाजत नहीं दी गयी। राजघाट पर पहुंचते ही हमारे मोबाइलों पर दरियागंज पुलिस स्टेशन से अधिकारियों से फोन आने लगे थे। आश्चर्य तो तब हो गया, जब असीम के मोबाइल पर इंडिया अगेंस्ट करप्शन से ऋषीकेश का भी फोन आया और उन्‍होंने असीम से पूछा कि राजघाट पर किये जा रहे इस प्रोग्राम के लिए टीम ‘सेव योर वाइस’ ने पुलिस परमिशन ली है या नहीं। और तो और, गेट से एंट्री कर रहे हर एक मेंबर से इस बारे में पड़ताल की जा रही थी कि कहीं वह सिब्बल्स डे के कार्यक्रम में हिस्सा लेने तो नहीं पहुंचा है। किसी तरह हम समाधि स्थल तक पहुंचे, जहां ब्‍लॉगर अन्ना भाई अपने कुछ मित्रों के साथ पहले से ही मौजूद थे। हमारे पीछे कम से कम पुलिस के 50 जवान पहुंच गये। जबरन हमें परिसर से बाहर निकाल दिया गया और रोड पार कर समता स्थल पर पुलिस घेरे के बीच खड़ा कर दिया गया। वहां ड्यूटी दे रहे पुलिस कांस्टेबल्स ने बताया कि वे हमारा इतजार सुबह नौ बजे से ही कर रहे थे।
समता स्थल पर भी बड़ी संख्या में पुलिस बल, आईबी, सीआईडी और सीबीआई के लोग मौजूद थे। आश्चर्य की बात है कि पुलिस ने पूर्व अनुमति होने के बावजूद सिब्बल दिवस का आयोजन नहीं होने दिया। कारण पूछने पर उच्चस्तरीय आदेशों का हवाला दिया गया और कहा गया कि उन्हें पीएमओ और आईटी मिनिस्ट्री से आदेश दिये गये हैं। पुलिस के ही कुछ लोगों ने बताया कि सीआईडी की एक रिपोर्ट के बाद हम पर एक्शन लिया गया है। मालूम पड़ा कि पीएमओ से एक रिप्रेजेंटेटिव भी वहां पहुंचे हुए हैं। आईबी के एक अधिकारी भी समता स्थल पर मौजूद थे। पत्रकार मित्रों के हवाले से सूचना मिली कि एक अप्रैल को राजघाट पर पेट्रोलिंग की 16 गाड़ियां लगायी गयी थीं और पीएमओ इस पर लगातार अपडेट्स ले रहा था। कुछ पत्रकार बंधुओं के पास आईबी से भी कार्यक्रम की जानकारी को लेकर पिछली रात फोन आये, जिनके बारे में हमें बाद में पता चल पाया। पुलिस ने राजघाट पर इस बात के भरपूर इंतजाम कर रखे थे कि सिब्बल्स डे न मनाया जा सके।
इस पूरे घटनाक्रम के साथ कुछ तार जोड़ने के लिए मैं आपको हिंदुस्तान टाइम्स की उस स्टोरी [स्‍टोरी लिंक] का जिक्र जरूर करना चाहूंगा, जिसमें बताया गया है कि किस तरह सरकार विरोधी गतिविधियों को कुचलने के दिल्ली पुलिस ने अनशन और प्रोटेस्ट की फीस निर्धारित कर दी है। अगर आप एक दिन का प्रोटेस्ट करना चाहते हैं, तो आपको दिल्ली पुलिस को सिक्योरिटी के बंदोबस्त के लिए कम से कम 70 से 75 हजार रुपये चुकाने होंगे। रेट लिस्ट कुछ ऐसी है…

मजेदार बात यह है कि इस लिस्ट से राजनीतिक और धार्मिक नेताओं को पूरी छूट मिली हुई है। मतलब कि आपको यह कीमत इसलिए चुकानी है कि आप एक आम आदमी हैं और अपनी आवाज को बुलंद करने का कोई हक नहीं रखते हैं। अगर आप ऐसी कोशिश करते हैं, तो आपको तमाम तरीकों से कुचला जाएगा और आखिरकार आप थक-हार कर या प्रशासनिक धमकियों से घबरा कर अपना इरादा बदल देंगे। अगर हमारी आवाज को इसी तरह दबाया जाना है, आवाज उठाने के लिए पैसे भरना है और बापू की समाधि पर बैठने पर भारी भरकम पुलिस बल द्वारा खदेड़ा जाना है, तो हम किस डेमोक्रेसी की कद्र करें। आखिर क्यूं न हम इस अन्याय के खिलाफ अपनी आवाज बुलंद करें। इंतजार करें, हम जल्द लौट रहे हैं पूरी ताकत के साथ।

फिर भी आइना सच ही दिखाएगा: Manu Manasvi

विनाशकाले विपरीत बुद्धि वाली कहावत इन दिनों केन्द्र की मनमोहनी कांग्रेस सरकार पर सटीक बैठती प्रतीत होती है। अन्ना और रामदेव फोबिया से घबराई सरकार जिस तरह अपनी चादर में छेद ढूंढ़कर उसमें पैबंद लगाने की बजाय उस छेद को बेनकाब करने वालों की हर आवाज को दबाने की मुहिम में जुटी है, उससे साफ होता है कि उनकी कमीज में ही दाग है, जिसे वो किसी भी कीमत पर औरों से उजली होने का झूठा दिखावा कर रही है। अब ये और बात है कि हर ईमानदार आवाज को कुचलने के बाद भी कांग्रेस बड़ी ही बेशर्मी से कहती है कि ये लोकतंत्र के हित में है।


मनु मनस्वी इस देश में जम्हूरियत का एक ही मंत्र है,
आईना दिखाने वालों को कुचलकर कह दो, ये लोकतंत्र है।

आखिरकार जैसा अंदेशा था, वही हुआ। कार्टूनिस्ट असीम त्रिवेदी को संसद का कार्टून बनाने की कीमत चुकानी पड़ी।  एक स्थानीय वकील की शिकायत पर मुंबई पुलिस की क्राइम ब्रांच ने कानपुर के युवा कार्टूनिस्ट असीम त्रिवेदी की वेबसाइट ‘कार्टून अगेंस्ट करप्शन डॉट कॉम’ पर प्रतिबंध लगा दिया है। क्राइम ब्रांच ने बेहद बचकाना तर्क देते हुए कहा है कि असीम ने अपने कार्टून के जरिए देश की भावनाओं को चोट पहुंचाई है। अब ये चोट कैसे पहुंची और इससे किस हद तक देश को हानि हुई, इसका कोई जवाब फिलहाल क्राइम ब्रांच के पास नहीं है।

मुंबई क्राइम ब्रांच का यह कदम न सिर्फ रसूखदारों और लोकतंत्र को अपने मन मुताबिक मोड़ लेने में माहिर राजनेताओं द्वारा सचाई की राह पर चल रहे लोगों को कुचलने का परंपरागत रूप है, बल्कि इसे कपिल सिब्बल की सोशल नेटवर्किंग साइट्स पर तिरछी हुई नजर के चलते मीडिया और सोशल नेटवर्किंग साइट्स पर सुनियोजित तरीके से नियंत्रण की शुरुआत के रूप में भी देखा जाना चाहिए। बता दें कि बीते दिनों सिब्बल ने सोशल नेटवर्किंग साइट्स पर अंकुश लगाने की बात कही थी। कपिल सिब्बल जैसे पढ़े-लिखे मंत्री का यह कहना कि फेसबुक, ट्विटर, गूगल और माइक्रोसॉफ्ट के प्लेटफार्म पर कुछ ऐसी सामग्री आयी हैं, जो कि लोगों की धार्मिक भावनाओं को चोट पहुंचा सकती हैं, सोशल मीडिया की पूरी गतिविधियों के प्रति उनकी अज्ञानता को ही दर्शाता है।

यह कोई पहली दफा नहीं है कि किसी ने सरकार को आईना दिखाने की कीमत चुकाई हो। रामदेव हों या अन्ना हजारे, जिसने भी सरकार की नीतियों का विरोध किया, उसे कुचलने के लिए सारी सरकार एक हो जाती है। अब इसे केन्द्र सरकार की बेशर्मी नहीं तो और क्या कहा जाए कि बीते एक दशक से भी लंबे समय से संघर्षरत शर्मिला इरोम की जायज मांगों को मानने की बजाय जबरन उसके हलक में खाना ठूंसकर कहती है कि सरकार इरोम की जान की फिक्र है। इससे पहले भी सरकार का दोगलापन तब सामने आया, जब सूचना का अधिकार कानून देकर अपनी पीठ थपथपाने वाली कांग्रेस ने इसे अपने ही लिए घातक प्रतीत होते देख इसमें ‘कुछ’ जरूरी बदलाव करने का फैसला लिया। यह अलग बात है कि चारों ओर से होने वाले विरोध के बाद उसे अपने कदम वापस खींच लेने पड़े।

असीम के कार्टून पहले भी सरकार की हकीकत से जनता को रूबरू कराते रहे हैं। लेकिन जब लगा कि चारों ओर से भ्रष्टाचार के आरोप झेल रही कांग्रेस सरकार की हकीकत यदि आम आदमी के सामने आ गई तो वर्षों से आम आदमी के साथ होने का दंभ भरने वाली कांग्रेस की कलई खुल जाएगी, तो अपना रुआब झाड़ते हुए कार्टून के साथ ही वेबसाइट पर भी प्रतिबंध लगा दिया। भ्रष्टाचार के खिलाफ होने का पाखंड करने वाली कांग्रेस पार्टी ए. राजा, कलमाड़ी और कनिमोझी जैसी तिकड़ियों की ओर तो आंखें मूंदे बैठी है, जिन्होंने अब तक के इतिहास में सबसे बड़े घोटाले कर भ्रष्टाचार के ‘नोबेल’ के लिए अपनी दावेदारी पुख्ता करने की जी तोड़ कोशिश की, लेकिन अपनी ओर उठती हर आवाज को कुचलने के लिए उसे लोकतंत्र के लिए घातक बताकर अपने तमाम ‘टूल बॉक्स’ लेकर पिल पड़ती है। उधर तमाम विरोधाभासों के बावजूद न्यायपालिका पर अपना विश्वास रखने वाले आम जन के विश्वास को बरकरार रखते हुए अदालत ने जिस तरह भ्रष्टाचार के मामले में लिप्त कांग्रेस के इन तीनों धुरंधरों पर एक-एक कर शिकंजा कसा है, उसने सरकार में बौखलाहट पैदा कर दी है और इसी बौखलाहट में वो बेहद हास्यास्पद कदम उठा रही है।

माना कि असीम के व्यंग्य को कुछ स्वनामध्न्य बुद्धिजीवी लोग संविधन का मखौल उड़ाना मानते हों, या इसे अपने द्वारा परिभाषित लोकतंत्र के लिए हानिकारक मानते हों, लेकिन सवाल ये है कि जब जनता द्वारा चुनकर भेजे गए सांसद संसद में खुलेआम नोट लहराते हैं, जूतमपैजार कर हंगामा करते हैं, या फिर सदाबहार रूप से छिछोरी चुटकुलेबाजी या फूहड़ बयानबाजी करते हैं, तब क्या वे संसद का मजाक नहीं उड़ाते? तब क्या वे देश की जनता का अपमान नहीं करते? पर ये ही तो है पॉवर का नशा।  पॉवर है तो हर खून माफ। पॉवर है तो सब कुछ लोकतंत्र की आड़ में सही सिद्ध हो जाता है (http://www.news.bhadas4media.com/index.php/creation/868-2012-03-02-13-29-42)

In India, for example, a 2008 amendment of the Information Technology Act diluted free speech provisions and put in place a blanket surveillance regime. Many countries across the world are doing likewise. A ‘Freedom of the Net 2011’ report, brought out by the American think-tank Freedom House, had this to say: ‘Even in more democratic countries—such as Brazil, India, Indonesia, South Korea, Turkey and the United Kingdom—internet freedom is increasingly undermined by legal harassment, opaque censorship procedures, or expanding surveillance.’


At the right end of the cartoon, a little above the halfway line, there is a roller with toilet paper. To the left, there is a pink flush, attached to a commode below with three flies hovering over it. The commode looks like the Indian Parliament. ‘National Toilet,’ says the cartoon’s title, with this line beneath the sketch: ‘Isme istamal hone wale toilet paper ko ballot paper bhi kehte hain’ (the toilet paper used here is also called ballot paper). When Anna Hazare went on his three-day fast in Mumbai in December, Aseem Trivedi was there with this cartoon as a banner.

Hazare began his fast on 27 December, and Trivedi, a cartoonist, came all the way from Kanpur, Uttar Pradesh. Along with other protestors, he turned up at Mumbai’s MMRDA grounds a day before. The next morning, clippings of his cartoons appeared in Hindustan Times and a Marathi paper called Prahaar. That afternoon, while Trivedi was at the fast venue, he began to get calls from friends saying that they couldn’t access his website, cartoonsagainstcorruption. com, which he had started in October by paying Rs 500 to Big Rock, a US-based domain registration and web hosting company. When he checked, he found an email from Big Rock that said that it had suspended the website after a complaint from the Mumbai Police.

After some correspondence, Big Rock gave Trivedi the name of a sub-inspector. The cartoonist tried contacting him, but couldn’t get through. The web hosting firm said it couldn’t reactivate the account without the complaint being withdrawn. A black hole had swallowed his website and he just couldn’t get it back. He learnt later through a newspaper report that a local Congress leader had filed the complaint on which the police acted. “Is a sub-inspector the Indian Constitution that he can decide unilaterally to block a website without hearing me out?” he asks.

You would be tempted to think that the State is out to get Trivedi. There is, however, a simpler explanation— laziness. The Mumbai Police’s cyber cell has no idea whether Parliament being portrayed as a commode is illegal. It is far easier to send an email to Big Rock. The web hosting company didn’t ask Trivedi because it assumed that the police had applied its mind because it is the police. But underlying this Kafka.net episode is the power that governments have given unto themselves to remove a cartoon even if they don’t understand it.

Given recent contexts, and for purposes of convenience, let use divide the yearning for internet control into two—the whip held by Kapil Sibal, and that wielded by the SOPA. As India’s Minister of Information Technology, Kapil Sibal, let it be remembered, had asked social networking sites to get a toothcomb and run it finely through millions of online updates for offensive and illegal content. SOPA, or Stop Online Piracy Act, a law which the United States plans to pass, seeks to stamp out copyright infringement by holding liable not just violators but everyone who feeds off them. So if a Google search throws up a link to an illegal Lady Gaga MP3 file, then Google is to be held accountable.

These two forms of control are different. Kapil Sibal wants political control over the internet, the US wants commercial control over it. Why not, you might say. Much of the web today is a sleazefest of child pornography, terrorism, piracy, and, of course, swindles pulled off by your friendly Nigerian scamster—‘ Inheritance Notice!!! Mrs Simon has picked your email for an inheritance of $18,000,000.00, for full details contact her via email on: ruth_28@rogers.com.’ Which sane citizen could object to getting all this cleansed and fumigated?

Vidya Reddy is with Tulir, an NGO that works to prevent and heal child sexual abuse. In the past three years, she has found that almost every case of sexual violence they’ve taken up had a technology angle to it. “Like taking photographs and uploading it,” she says. Forcibly taken pictures are a problem even for adult women in India, where power inequities often mean that it is not only children who are helpless.

It isn’t just perverts. Terrorists too like the freedom of the net. Some are not even anonymous. A Somali terror group called al-Shabaab boasts of a Twitter account. It goes under the rather harmless handle of @HSMPress. And their tweets go like this: ‘HSM Martyrdom Brigade has this morning carried out a successful Martyrdom Operation against Ethiopian invaders in Baladweyne#JihadDispatches’, ‘War Statistics Office confirms 33 Ethiopian troops dead, incl 4 senior commanders & up to 72 injured; the number is steadily increasing’. Gabriel Weimann, a professor at University of Haifa in Israel, recently did a study that showed that terror groups are networking happily across social media, even recruiting. A press release about his study mentions a query found on an online forum of the Hamas’ military wing: ‘I have a kilogram of acetone. I want to know how to make an explosive with it to blow up a military jeep.’

Or take the suffering of Bollywood on account of internet piracy. Sanjay Tandon heads the anti-piracy division of Reliance Entertainment, which produced some of last year’s top movies. He says that before hitting theatres with Singham, the Ajay Devgn starrer, they scanned the net and found as many as 90,000 online links to pirated copies of new releases. “The main business of a film is the first Friday, Saturday and Sunday,” he says, “The entire film is pirated and available on the net within a few hours or within a day of its release.”

In this glorious pursuit to make the internet wholesome again, does it matter if a not-so-evil website is suspended? In war, there is always collateral damage. Maybe Aseem Trivedi was just unfortunate to be at the wrong protest at the wrong time with the wrong cartoon.

Even in a perfect world, where the State is not corrupt or malicious, that would not be true. Governments and their institutions are—literally—slow thinking creatures. When a new phenomenon like social networking bursts out of nowhere, it is difficult for them to comprehend its nuances. It’s a little like your grandmother’s befuddlement over using a mobile phone. The standard response by the State is to draft either draconian or vague laws that give it overarching policing powers. To justify these laws, the State’s approach is to take the worst of what is out there, and use that as a template for the setting up of controls that police everyone as if they were the worst.

In India, for example, a 2008 amendment of the Information Technology Act diluted free speech provisions and put in place a blanket surveillance regime. Many countries across the world are doing likewise. A ‘Freedom of the Net 2011’ report, brought out by the American think-tank Freedom House, had this to say: ‘Even in more democratic countries—such as Brazil, India, Indonesia, South Korea, Turkey and the United Kingdom—internet freedom is increasingly undermined by legal harassment, opaque censorship procedures, or expanding surveillance.’

Totalitarian regimes are at least open about their effort to control the net. China, in the discourse of the free world, is the online Mordor. By one estimate, it has 30,000 internet policemen glaring at what its citizens are doing online. Nazia Vasi, founder and CEO, Inchin Closer, an India-China language and cultural consultancy, spent some four years in the country, ending 2009. Back then, she could easily access social networks like Facebook and Twitter. In 2011, she went back to China and found it impossible to get onto those two sites. But the Chinese, she says, still have an extraordinarily vibrant internet culture: “In a country where its one-child policy is still dominant, [the net] is a place where single children can share their views, discuss fears and contemplate life changing decisions. In the country with the world’s largest internet population, being online is a part of life.” It’s just that they must use their own all-Chinese networks. Instead of Facebook, they have Kai Xin, instead of MSN Chat they have QQ, instead of Twitter they have Weibo, and for Google there is Baidu. You can’t have a free discussion on the Tiananmen Square uprising, but, if you steer clear of politics, you can be quite content online.

The West, the US in particular, considers the Great Firewall of China an outright affront to free speech. But you do not hear US diplomats get hot-collared about Burma or North Korea’s online behaviour. The difference is that China is a huge market, and the Great Firewall— put up to insulate the country from external internet influence— implies commercial damage for US companies. On 18 January, those who logged on to Wikipedia found a screen that said: ‘Imagine a World Without Free Speech.’ The site had blocked itself out for a day, and not in protest against Chinese but American policy. Google, Mozilla and 7,000 other sites also protested in their own way against SOPA. Following the protest, SOPA has been put on hold, but if it ever goes through, even Indians have reason to worry about this proposed law. It is actually aimed at websites in other countries that could be doing perfectly legal things. Sunil Abraham of the Centre for Internet and Society, a Bangalore-based think-tank, calls SOPA the “Great Firewall of China on Steroids”, an American attempt to wield a whip across the entire online world.

Abraham explains it using the example of a mobile phone, which can have as many as 20,000 patents on it. Consider a model produced by an Indian handset maker, Spice Popkorn M9000, which is equipped with technologies like a dual SIM card, an FM radio receiver, inbuilt projector, laser pointer, and so on. If it sells here for as little as Rs 6,500, it is “because many of the 20,000 patents are not registered in the Chinese and Indian jurisdictions”, says Abraham. “Suppose there is a website selling M9000 phones to the Latin American, African or Indian market. Under SOPA, US holders of [intellectual property rights] can approach the court, get an order, and seize the domain name or make the website disappear not only for US consumers but for everybody else.”

The US can do that because it holds the levers to the internet. ICANN, the body responsible for names and numbers on the internet (your URL, for instance), is an NGO with its headquarters in the US. Nikhil Pahwa, editor of the online digital media magazine Medianama, remembers a case last year in the UK against an Indian website that he won’t name. The UK party got an injunction and then went with it to a registrar in the US and got it blocked. The Indian party was not even informed.

Just a day after the Wikipedia protest, Megaupload, a file storage and sharing website, was shut down after a US court ruled that its uploads and downloads violated its copyright laws. The owner, Kim Schmitz, was arrested. Why was it so galling to the online community? Because Megaupload operated from Hong Kong and New Zealand. Schmitz, a German citizen, was picked up in New Zealand.

The ‘Freedom of the Net’ report assigns countries scores between 0 and 100, with 0 being the best and 100 the worst. India gets 36, which means it is partly free (and has actually knocked off a couple of points since 2009). Surprisingly, Estonia, a former Soviet Bloc country, is found to be the most free, with a score of 10, followed by the US with 12 (what SOPA might do to this score, we can’t hazard a guess yet). Unsurprisingly, Iran is ranked the worst, with a score of 89.

The Indian case, on the ground, is actually eerie if not funny. By a strange quirk of legislation, not just governments, anyone can potentially yank a website off the net. The Centre for Internet and Society conducted a sting operation to highlight how. It sent random takedown notices to seven intermediaries like search engines and news websites. Of seven, six over-complied. “We said ‘Delete six comments’, they deleted 13,” says Abraham, “We said ‘Block three URLs, they blocked the whole website.” And all it took was a few letters sent.

Ascribe this peculiarity to the IT Act’s 2008 amendment, which assures intermediaries of legal immunity for only 72 hours from the time of their receipt of a takedown notice. To understand what this implies, consider the case of Avnish Bajaj, CEO of Bazee.com, an Indian online auction site that has since been bought by eBay. In 2004, he was arrested after an MMS sex scandal clip was found to have been sold on the site. Intermediaries had no immunity at all back then. The amendment now means that they cannot be prosecuted merely because their site was used for something illegal. But it also means that they take no chance once they do get a notice, and are willing to bend over backwards to safeguard themselves. “Prior to 2008, you would have to get a court order to get things deleted,” says Abraham, “Now we can just send a threatening letter and they are happy to undertake deletions. So instead of a judicial censorship regime, private businesses with absolutely no interest in protecting free speech now have that power, and there are no safeguards against their abusing it.”

Worse, as Pahwa of Medianama says, when sites do get barred, their owners get no notice at all. “In March last year, we started getting reports from our readers that certain sites were being blocked on some ISPs like Airtel. And then we found that there are sites being blocked on MTNL, Reliance, etcetera.” When an RTI application helped obtain a list of blocked sites, many of the barred sites they knew of were not in that list. “Where is the transparency?” asks Pahwa, “When a site gets blocked, it is not told why it is blocked, who has asked for it to be blocked, what the process is for getting it unblocked, or who to contact for it.”

Internet censorship, TO Abraham’s mind, ought to be like salt in food—just enough to make it effective and not so much as to destroy the whole thing. But how do you create the perfect salt-shaker? There’s really no answer at present. Absolute internet policing cannot work without turning India into another China, or worse, North Korea, which has successfully policed thought itself. Societies that are not ruthless will always find it hard to enforce unacceptable bans. Countries whose institutions are incompetent will find it hard to implement laws even against evils that everyone accepts must be done away with.

In her experience with the police, Vidya Reddy of Tulir says that they still shy away from the role of technology in many cases. Although the 2008 amendment introduced a section against child pornography—right from its creation and dissemination to its consumption—rarely do the police invoke Section 67B of the Act against the perpetrator in a court of law. “They only look at the aspect of sexual violence that has been committed, and book them under appropriate laws,” she says, “ Why would police officers make the effort, increasing their workload? They’ll have to then send the device, computer hard disks, etcetera, to a cyber forensic lab to process the evidence.”

Moreover, even if the Government kills something on the net, a reincarnation can always pop up. The sex life of Savita Bhabhi, the fictional animated housewife, had gathered enough online popularity for it to be banned in 2009. “We went ahead and created Kirtu.com, which is now the new home of Savita Bhabhi and a few of her new friends,” says Puneet Agarwal, its creator. “We did lose some traffic after the ban, but most of her fans just got wind of the new address and Savita was back to her naughty antics as if nothing happened.”

So also with Aseem Trivedi, the cartoonist. The experience has turned him into a sort of full-time activist. He has floated a body against censorship, and goes about giving talks on the subject to students in Delhi. After his website got suspended, he just set up a free blog account, cartoonsagainstcorruption. blogspot.com, and put up his cartoons there. A toilet bowl in the shape of Indian Parliament can still be seen online.

Facebook users are more on the receiving end; Pew study


Philanthropy on ground would acquire a different meaning, if the inclination to give was as strong as sharing on Facebook.

A study conducted by the Pew research center’s internet and American life project on 269 facebook users in the month of November 2010 reveals that users of the social networking site give out a lot more than they receive. The survey was carried out through a random telephone survey with consent from facebook users.

The results pointed out that 20-30% of users evaluated were more active than the average users on facebook.  Their activities though, were not alike. Some of the frequent users liked sharing information, for some uploading images was a regular fixture, while some spend a lot of their time sending friend requests. It was noted that users received a lot more friend requests than what they individually sent out. 5% of users spent time on all activities available on the networking site.

The results of the research hold significance as it was presented two days after Facebook filed for an initial public offering of $ 5 Billion that could skyrocket, the future value of facebook to $100 Billion.

The use of facebook by different users around the world did not evaluate the financial worth of the users but shed light on the usage of the popular social networking platform.

Facebook relies heavily on its 850 million users worldwide to convince advertisers and investors that the platform is worth a lot more as it provides ample connectivity to help businesses reap maximum benefits through the portal.

The notion that consistent regular use of facebook would lead to fatigue on part of users was nullified as research showed that people spending time on facebook were getting more addicted to networking as they spent longer durations on the site.

Keith Hampton, the study’s main author and a Rutgers University Professor said, ‘it was hard to give up on facebook, for the positive impact it had on individual lives.’ He elaborated saying, it felt good to be on facebook with a whole lot of attention showered by friends and family.  The absence of a dislike button ensured that all information shared fell in the ‘like’ category, another motivator for users to spend time on the network. Hampton added, ‘more time people spent on facebook, the more they wanted to do facebook. Emotionally people were receiving a lot more than sharing or giving, is exactly what most people are looking for.

The study conducted in October/November 2010 interviewed 2255 facebook users over phone with an error margin of plus or minus 2.3 percentage points. 12% of individuals agreed to share their facebook data, at the end of the survey.

जब तक खुद को निर्दोष साबित नहीं करते, आप अपराधी हैं!

हाथ से बनाया गया एक चिन्ह है, जो एक छोटी सी बेकरी मे लगा था कुछ साल पहले ब्रुकलिन में मेरे पडोस के इलाके में। इस बेकरी में एक छोटी से मशीन लगी थी, जो कि शुगर-प्लेट पर छपाई कर सकती थी। और बच्चे अपनी-अपनी ड्राइंग लाते थे और दुकान में एक शुगर-प्लेट पर छपवा कर अपने बर्थ-डे केक के ऊपर लगाते थे।

मगर दुर्भाग्यवश, एक चीज जो बच्चे खूब बनाते हैं, वो है कार्टून चरित्रों की ड्राइंग। उन्हें मजा आता है लिटल मर्मेड बना कर, स्मर्फ बना कर, मिकी माउस बना कर। मगर असल में ये गैर-कानूनी है कि मिकी माउस का चित्र जो एक बच्चे ने बनाया है, एक शुगर-प्लेट पर छापा जाए। और ये कॉपी-राइट का हनन है। और ऐसे कॉपी-राइट को बच्चों के केक से बचाना इतना उलझा हुआ काम था कि कॉलेज बेकरी ने कहा, “ऐसा है, हम ये काम ही बंद कर रहे हैं। अगर आप शौकिया कलाकार हैं, तो आप हमारी मशीन का इस्तेमाल नहीं कर सकते। अगर आपको अपने बर्थ-डे केक पर छपाई चाहिए, तो आपको हमारे पास पहले से उपलब्ध चित्रों में से एक लेना होगा … केवल पेशेवर कलाकारों द्वारा बनाये गये चित्रों से।”

तो कांग्रेस में इस वक्त दो विधेयक पेश हो चुके हैं। एक है सोपा (SOPA) और दूसरा है पीपा (PIPA)। सोपा (SOPA) का अर्थ है स्टॉप ऑनलाइन पायरेसी एक्ट। ये सेनेट से आया है। पीपा (PIPA) लघु रूप है PROTECTIP का, जो कि स्वयं लघुरूप है प्रिवेंटिंग रियल ऑनलाइन थ्रेट्स टू इकॉनामिक क्रिएटिविटी एन्ड थेफ्ट ऑफ इन्टेलेक्चुअल प्रोपर्टी … इन चीजों को नाम देने वाले कांग्रेस के नुमाइंदों के पास बहुत ढेर सारा फालतू समय होता है। और सोपा और पीपा नाम की बलाएं आखिरकार करना ये चाहती हैं कि वो इतना महंगा बना देना चाहती हैं कॉपी-राइट के दायरे में रह कर काम करने को कि लोग उन काम-धंधों को छोड़ ही दें, जिनमें शौकिया रचना करने वाले शामिल होते हैं।

अब, ऐसा करने के लिए उनका सुझाव ये है कि उन वेबसाइटों को पहचान लिया जाए जो कॉपी-राइट हनन कर रहे हैं। हालांकि ये साइट कैसे कॉपी-राइट हनन कर रहे हैं, विधेयक इस मुद्दे पर चुप्पी साधे बैठा है … और फिर वो इन साइटों को डोमेन नेम सिस्टम से बर्खास्त कर देना चाहते हैं। वो इन्हें डोमेन नेम सिस्टम से निष्कासित कर देना चाहते हैं। देखिए, ये डोमेन नेम सिस्टम ही है, जो कि इंसानों को समझ आने वाले नामों को, जैसे कि गूगल डॉट कॉम, उन नामों में बदलता है जिन्हें कंप्‍यूटर समझता है … जैसे कि 74.125.226.212

असल खराबी इस सेंसरशिप के मॉडल में है, जो कि इन साइटों को ढूंढेगा, फिर उन्हें डोमेन नेम सिस्टम से हटाने की कोशिश करेगा, पर शायद ये काम नहीं करेगा। और आपको लग रहा होगा कि ये कानून के लिए खासी बड़ी दिक्कत होगी, मगर कांग्रेस इस बात से जरा भी परेशान नहीं लगती है। ये सिस्टम धवस्त इसलिए हो जाएगा, क्योंकि आप अब भी अपने ब्राउजर में 74.125.226.212 टाइप कर के या उसको क्लिक करने लायक लिंक बना कर अब भी गूगल तक पहुंच पाएंगे। तो जो सुरक्षात्मक घेरा इस समस्या के आसपास खड़ा किया गया है, वही इस एक्ट का सबसे बड़ा खतरा है।

कैसे कांग्रेस ने ऐसा विधेयक लिख डाला, जो कि अपने मुकर्रर लक्ष्यों को कभी पूरा नहीं करेगा, मगर एक हजार नुकसानदायक साइड इफेक्ट बना डालेगा, ये समझने के लिए आपको इसकी कहानी में गहरे पैठना होगा। और कहानी कुछ ऐसी है…

सोपा और पीपा, ऐसे विधेयक हैं जिनका ड्राफ्ट मुख्यतः उन मीडिया कंपनियों ने लिखा जो कि बीसवीं सदी में शुरू हुई थीं। बीसवीं सदी मीडिया कंपनियों के लिए स्वर्णिम समय था, क्योंकि मीडिया कंटेट की बहुत ही ज्यादा कमी थी। अगर आप कोई टीवी शो बना रहे हैं, तो उसे बाकी सारे टीवी शो से बेहतर नहीं होना होगा; उसे केवल बेहतर होना होगा बाकी दो शो से, जो उसी समय प्रसारित होते हों … जो कि बहुत ही हल्की शर्त है स्पर्धा के लिहाज से। जिसका मतलब है कि यदि आप बिलकुल औसत कंटेंट भी बना रहे हैं, तो फ्री में अमरीका की एक-तिहाई पब्लिक आपकी बात सुनने को मजबूर है। कई लाख लोग एक साथ आपको सुन रहे हैं, तब भी, जबकि आपका बनाया कुछ खास नहीं है। ये ऐसा है, जैसे आपको नोट छापने का लाइसेंस मिल जाए, और साथ ही फ्री इंक भी।

मगर टेक्नालाजी आगे बढ़ गयी, जैसा कि वो हमेशा करती है। और धीरे-धीरे, बीसवीं शताब्दी के अंत तक, कंटेट की वो कमी खत्म सी होने लगी … और मेरा मतलब डिजिटल टेक्नालाजी से नहीं है, साधारण एनालाग टेक्नालाजी भी जरिया बनी। कैसेट टेप, वीडियो कैसेट रेकार्डर, यहां तक कि जेराक्स मशीन भी नये अवसर पैदा करने लगी ऐसे क्रियाकलापों के लिए, जिन्‍होंने इन मीडिया कंपनियों की हवा निकाल दी। क्योंकि अचानक इन्हें पता लगा कि हम लोग सिर्फ चुपचाप बैठ कर देखने वाले लोग नहीं हैं। हम सिर्फ कनज्‍यूम करना ही नहीं चाहते। हमें कनज्‍यूम करने में मजा आता है, मगर जब भी ऐसे नये अविष्कार हम तक पहुंचे, हमने कुछ रचने की भी कोशिश की और अपनी रचना को शेयर करने, बांटने का प्रयास किया। और इस बात ने मीडिया कंपनियों को घबराहट में डाल दिया … हर बार उनकी हालत पतली ही हुई।

जैक वलेंटी ने, जो कि मुख्य लॉबीइस्‍ट थे मोशन पिक्चर एसोसिएशन ऑफ अमेरिका के, एक बार घृणा योग्य वीडियो कैसेट रिकार्डर की तुलना जैक द रिपर से की थी और गरीब, हताश, बेचारे हॉलीवुड की उस कमजोर औरत से जो घर पर अकेले शिकार होने को बैठी है। इस स्तर पर चीख-पुकार मचायी गयी थी।

और इसलिए मीडिया इंडस्ट्री ने गिड़गिड़ा कर, जोर डाल कर, ये मांग रखी कि कांग्रेस कुछ करे। और कांग्रेस ने किया भी। 90 के दशक के पूर्वार्ध तक, कांग्रेस ने ऐसा कानून बनाया, जिसने सब कुछ बदल दिया। और उस कानून का नाम था ‘द ऑडियो होम रेकार्डिंग एक्ट’ सन 1992 का। 1992 का द ऑडियो होम रिकार्डिंग एक्ट ये कहता है कि देखिए, अगर लोग रेडियो प्रसारण को रिकार्ड कर रहे हैं, और फिर दोस्तों के लिए खिचड़ी-कैसेट (रीमिक्‍स) बना रहे हैं, तो ये अपराध नहीं है। इसमें कोई गलत बात नहीं है। टेप करना, रीमिक्स करना, और दोस्तों में बांटना गलत नहीं है। यदि आप कई सारी उम्दा क्वालिटी की कॉपी बना कर बेच रहे हैं, तो ये बिल्कुल भी सही नहीं है। मगर ये छोटा-मोटा टेप करना वगैरह ठीक है, इसे चलने दो। और उन्हें लगा कि उन्‍होंने मसले को हल कर दिया है, क्योंकि उन्होंने साफ लकीर बना दी थी – कानूनन गलत और कानूनन सही कॉपी करने के बीच।

मगर मीडिया कंपनियों को ये नहीं चाहिए था। वो ये चाहते थे कि कांग्रेस किसी भी तरह की कॉपी करने पर पूर्ण रोक लगा दे। तो जब 1992 का ऑडियो होम रेकार्डिंग एक्ट पास हुआ, मीडिया कंपनियों ने ये विचार ही छोड़ दिया कि कॉपी करना किसी स्थिति में कानूनन सही माना जा सकता है क्योंकि ये साफ था कि यदि कांग्रेस इस नजरिये से सोचेगी, तो शायद नागरिकों को अपने मीडिया परिवेश में रचनात्मक भागीदारी करने के और भी अधिकार मिले। तो उन्‍होंने दूसरी ही योजना बनायी। उन्हें इस योजना को बनाने में थोड़ा समय जरूर लगा।

ये योजना पूर्ण रूप से सामने आयी सन 1998 में … डिजिटल मिलेनियम कॉपीराइट एक्ट के रूप में। (डीएमसीए) ये अत्यधिक जटिल कानून था, हजारों हिस्सों में बंटा हुआ। मगर डीएमसीए का मुख्यतः जोर ये था कि ये कानूनन सही है कि आपको ऐसा डिजिटल कंटेट बेचा जाए, जिसे कॉपी नहीं किया जा सकता … बस इतनी सी गलती हुई कि ऐसा कोई डिजिटल कंटेट नहीं हो सकता, जो कॉपी न हो सके। ये ऐसा था, जैसा कि एड फेल्टन ने कहा था, “ऐसा पानी बेचना जो गीला न हो।” बिट्स तो कॉपी लायक होते ही हैं। यही तो कंप्‍यूटर करते हैं। ये तो उनके सामान्‍य काम करने के तरीके का निहित अंग है।

तो ऐसी काबिलियत के नाटक के लिए कि असल में कॉपी नहीं होने वाले बिट्स बिक सकते हैं, डीएमसीए ने ये भी कानूनी रूप से सही करार दिया कि आप पर ऐसे सिस्टम थोपे जाएं, जो आपके यंत्रों की कॉपी करने की काबिलियत खत्म कर दें। हर डीवीडी प्लेयर और गेम प्लेयर और टीवी और कंप्‍यूटर जो आप घर ले जाते रहे… आप चाहे जो सोच कर उसे खरीद रहे थे … कंटेट इंडस्ट्री द्वारा तोड़ा जा सकता था, अगर वो चाहते कि इसी शर्त पर आपको कंटेंट बेचेंगे। और ये सुनिश्चित करने के लिए कि आपको ये पता न लगे, या फिर आप उस यंत्र की साधारण कंप्‍यूटरनुमा गतिविधियों को इस्तेमाल न कर पाएं, उन्होंने ये गैर-कानूनी करवा दिया कि आप रीसेट कर सकें उनके कंटेंट को कापी होने लायक बनाने के लिए। डीएमसीए वो काला क्षण है, जबकि मीडिया इंडस्ट्री ने उस कानूनी सिस्टम को ताक पर रख दिया, जो कानूनी और गैर-कानूनी कॉपी में फर्क करता था, और पूरी तरह से कॉपी रोकने का प्रयास किया, तकनीक के इस्तेमाल से भी।

डीएमसीए के कई जटिल असर होते आये हैं, और हो रहे हैं, और इस संदर्भ में उसका असर है – शेयरिंग पर कसी गयी लगाम, मगर वो ज्यादातर नाकामयाब ही हुए हैं। और उनकी इस असफलता का मुख्य कारण रहा है ये कि इंटरनेट ज्यादा फैला है और ज्यादा शक्तिशाली बन कर उभरा है, किसी की भी सोच के मुकाबले। टेप मिक्स करना, फैन मग्जीन वगैरह निकालना कुछ भी नहीं है उसके मुकाबले, जो आज घटित हो रहा है इंटरनेट पर।

हम आज ऐसे विश्व के बाशिंदे हैं, जहां ज्यादातर अमरीकी जो 12 वर्ष से बड़े हैं, एक दूसरे से ऑनलाइन चीजें शेयर करते हैं। हम लेख शेयर करते हैं, तस्वीरें साझा करते हैं, ऑडियो, वीडियो सब साझा करते हैं। हमारी शेयर की गयी चीजों में से कुछ हमारी खुद की बनायी होती हैं। कुछ ऐसी सामग्री होती है, जो हमें मिली होती है। और कुछ ऐसी सामग्री भी, जो हमने उस कंटेट से बनायी होती है, जो हमें मिला, और ये सब मीडिया इंडस्ट्री के होश उड़ाने के लिए काफी है।

तो पीपा और सोपा इस युद्ध की दूसरी कड़ी है। मगर जहां डीएमसीए अंदर घुस कर काम करता था … कि हम आपके कंप्‍यूटर में घुसे हैं, आपके टीवी का हिस्सा हैं, आपके गेम मशीन में मौजूद हैं, और उसे वो करने से रोक रहे हैं, जिसके वादे पर हमने उन्हें खरीदा था … पीपा और सोपा तो परमाणु विस्फोट जैसे हैं और ये कह रहे हैं कि हम दुनिया में हर जगह पहुंच कर कंटेंट को सेंसर करना चाहते हैं। और इसे करने की विधि, जैसे मैने पहले कहा, ये है कि आप हर उस लिंक को हटा देंगे, जो उन आईपी एड्रेस तक पहुंचेंगे। आप को उन्हें सर्च इंजिन से हटाना होगा, आपको ऑनलाइन डाइरेक्ट्रियों से हटाना होगा, आपको यूजर लिस्टों से हटाना होगा। और क्योंकि इंटरनेट पर कंटेट के सबसे बड़े रचयिता गूगल या याहू नहीं हैं, आप और हम हैं, असल में निगरानी आपकी और हमारी ही होगी। क्योंकि आखिर में, असली खतरा पीपा और सोपा के कानून बनने से हमारी चीजों को शेयर करने की काबिलियत को है।

तो पीपा और सोपा से खतरा ये है कि ये सदियों पुराने कानूनी सिद्धांत को, कि “जब तक सिद्ध नहीं, अपराधी नहीं” उलट देंगे कि – “जब तक सिद्ध नहीं, अपराधी” में आप शेयर नहीं कर सकते जब तक कि आप ये न दिखा दें कि आप जो शेयर कर रहे हैं, वो इनके हिसाब से ठीक है। अचानक, कानूनी और गैर-कानूनी होने का पूरा दारोमदार हम पर ही गिर जाएगा। और उन सेवाओं पर जो हमें नया नया काम करने की काबिलियत देना चाहती हैं। और अगर सिर्फ एक पैसा भी एक यूजर की निगरानी में खर्च हो, तो कोई भी ऐसी सेवा दिवालिया हो जाएगी, जिसके सौ मिलियन यूजर होंगे।

और यही इंटरनेट है इनके दिमाग में। सोचिए हर जगह ऐसा ही निशान लगा हो … और यहां कॉलेज बेकरी न लिखा हो, यहां लिखा हो यू-ट्यूब और फेसबुक और ट्विटर। सोचिए यहां लिखा हो टेड, क्योंकि कमेंटों की तो निगरानी हो ही नहीं सकती है किसी भी कीमत पर। सोपा और पीपा का असल असर बताये जा रहे असर से बहुत अलग होगा। असल खतरा ये है कि साबित करने का काम उलटी पार्टी का हो जाएगा, जहां अचानक हम सभी को चोरों की तरह देखा जाएगा, हर क्षण जब भी हम रचना की स्वतंत्रता का इस्तेमाल करेंगे, कुछ बनाने या शेयर करने के लिए। और वो लोग जिन्होंने हमें ये काबिलियत दी है … दुनिया भर के यू-ट्यूब, फेसबुक, ट्विटर और टेड – उनका मुख्य काम हमारी निगरानी करने का हो जाएगा, कि कहीं हमारे द्वारा शेयर की गयी चीज से उन पर तो फंदा नहीं कस जाएगा।

अब दो काम हैं, जो आप कर सकते हैं इसे रोकने के लिए … एक साधारण काम है और एक जटिल काम है, एक आसान काम है और एक कठिन है।

साधारण आसान काम ये है : यदि आप अमरीकी हैं, तो अपने विधायक को कॉल कीजिए। जब आप देखेंगे कि कौन लोग हैं, जिन्होंने सोपा को बढ़ावा दिया है, और पीपा के लिए प्रचार किया है, आप देखेंगे कि उन्होंने लगातार कई सालों से दसियों लाख डॉलर पाये हैं पारंपरिक मीडिया इंडस्ट्री से। आपके पास दसियों लाख डॉलर नहीं हैं, लेकिन आप अपने नेताओं को कॉल करके ये याद दिला सकते हैं कि आप के पास वोट है, और आप नहीं चाहते कि आपके साथ चोरों जैसा बर्ताव हो, और आप उन्हें सुझाव दे सकते हैं कि आप चाहेंगे कि इंटरनेट की कमर न तोड़ी जाए।

और अगर आप अमरीकी नहीं हैं, तो आप उन अमरीकियों से बात कीजिए, जिन्हें आप जानते हैं, और उन्हें उत्साहित कीजिए ये करने के लिए। क्योंकि इसे राष्ट्रीय मुद्दा बनाया जा रहा है, मगर ये है नहीं। ये इंडस्ट्री सिर्फ इस पर नहीं रुकेगी कि इसने अमरीका के इंटरनेट पर कब्जा कर लिया। यदि ये सफल हुए, तो दुनिया भर का इंटरनेट कब्जा लेंगी। ये तो था आसान काम। ये था साधारण काम।

अब कठिन काम : तैयार हो जाइए, क्योंकि और भी हमले होने वाले हैं। सोपा असल में कोयका (COICA) का नया रूप है, जिसे पिछले साल पेश किया गया था, मगर वो पास नहीं हुआ। और ये सारी कहानी ठहरती है डीएमसीए के असफल हो जाने में, टेक्नालाजी का इस्तेमाल करके शेयरिंग रोक पाने में असफल होने में। और डीएमसीए ठहरता है द ऑडियो होम रिकार्डिंग एक्ट पर, जिसने इस इंडस्ट्री के शहंशाहों की हवा निकाल दी थी। क्योंकि ये जटिल है कि पहले कहा जाए कि कोई कानून तोड़ रहा है और फिर सबूत इकट्ठे करना और सिद्ध करना, ये काफी असुविधा भरा है। “काश इसे सिद्ध करने के झमेले में न पड़ना पड़े” कंटेंट कंपनियां ये सोचती हैं। और वो इस झमेले में पड़ना ही नहीं चाहतीं कि ये सोचना पड़े कि क्या फर्क है कानूनी और गैर-कानूनी में। वो तो बस सीधा सरल उपाय चाहती हैं कि शेयरिंग बंद हो जाए।

पीपा और सोपा कोई नयी बात या अलग सा आइडिया नहीं है, न ही ये आज शुरू हुआ कोई खेल है। ये तो उसी पुराने पेंच का अगला घुमाव है, जो पिछले बीस साल से षड्यंत्र कर रहा है। और अगर हमने इसे हरा दिया, जैसा मैं आशा करता हूं, और हमले आएंगे। क्योंकि जब तक हम कांग्रेस को विश्वास नहीं दिला देते कि कॉपीराइट हनन से निपटने का सही उपाय वो है, जो कि नैप्स्टर या यूट्यूब ने इस्तेमाल किया, जहां एक सुनवाई होती है सारे सबूतों के साथ, सारे तथ्यों पर विचार कर के, और उपायों पर विमर्श कर के, जैसा कि प्रजातांत्रिक समाजों में होता है। यही सही तरीका है इस से निपटने का।

और इस बीच, कठिन काम ये है कि कमर कस लीजिए। क्योंकि यही पीपा और सोपा का असली संदेश है। टाइम वार्नर ने बुलावा भेज दिया है और वो हमें वापस सिर्फ कनज्‍यूमर बनाना चाहते हैं – काउच पोटेटो (couch potato) हम न रचें, न हम शेयर करें … और हमें जोर से कहना चाहिए, “नहीं।”
